Ever Thrive Garden
Grow Naturally, Bloom Timelessly
At Ever Thrive Garden, we provide a selection of garden seeds, starter plants, seedlings, cuttings, bulbs, roots, and other natural planting materials.
Because many of these products are living or perishable, their appearance, condition, and growing performance may vary. We encourage all customers to read the following return and refund guidelines, along with individual product descriptions, before making a purchase.
1. Final Sale Policy
All purchases are considered final unless an exception is specifically outlined in this policy or required by applicable consumer protection laws.
Under our standard policy, returns, refunds, and replacements are generally not available for the following circumstances:
-
Seeds that do not germinate or cuttings that fail to develop roots.
-
Plants that do not establish, grow successfully, produce flowers, or bear fruit.
-
Plants that deteriorate or die after delivery due to unsuitable conditions or improper maintenance.
-
Purchases made in error, unwanted products, or changes in customer preference.
-
Products that have been opened, planted, used, modified, or otherwise altered.
-
Healthy seeds, plants, bulbs, cuttings, or roots delivered in accordance with their descriptions.
-
Naturally occurring differences in plant height, form, color, branching, leaves, or root systems.
-
Normal seasonal dormancy, pruning, foliage loss, or temporary transportation stress.
These limitations do not affect consumer rights or legal remedies that cannot be excluded under applicable law.
2. Reporting Issues Within 48 Hours
Customers must report delivery-related concerns in writing by email to [Insert Ever Thrive Garden customer support email] within 48 hours of the carrier-confirmed delivery date and time.
The 48-hour reporting window begins when the shipping provider updates the shipment status to delivered.
Claims submitted through social media, telephone conversations, messaging applications, or other communication channels do not fulfill our standard email reporting requirement.
Information Required for Claim Review
To help us review your concern, please provide:
-
Order number (mandatory).
-
Full name associated with the purchase.
-
A short written description explaining the issue.
-
Clear photographs of the exterior shipping package.
-
A readable photograph of the shipping label.
-
Pictures of the internal packaging materials.
-
Multiple photographs showing the entire affected plant or product.
-
Close-up images clearly illustrating the reported damage or concern.
-
Scratch test photographs, when applicable, for woody plants believed to be dead or dormant.
A valid order number is essential for locating and verifying your purchase.
Please retain the original packaging and the affected product until your claim has been reviewed.
Claims received more than 48 hours after confirmed delivery may be declined under our voluntary replacement and refund program.
We may also be unable to approve a claim when essential order details, photographs, or documentation are missing and the reported concern cannot reasonably be verified.
For purposes of our voluntary claims process, failure to notify us within the specified period may be treated as acceptance of the item's visible condition upon delivery.
Please remember: Plants showing dormancy, wilting, leaf loss, transportation shock, or temporary stress are not necessarily dead or defective.
Submitting a claim does not automatically qualify an order for reimbursement or replacement. Every request must undergo review.
This reporting procedure does not restrict any mandatory consumer protections or remedies provided by law.
3. Product Images & Natural Plant Differences
Images displayed on our website are intended for illustration and product identification purposes.
Depending on the listing, photographs may feature fully grown plants, representative examples, or specimens from available nursery inventory.
Unless the listing explicitly states otherwise, the specific plant or tree shown in a product photograph is not necessarily the exact specimen you will receive.
Plants are selected according to the listed product specifications and available stock.
Natural differences may include:
-
Overall plant height, width, and growth form.
-
Trunk diameter and branching patterns.
-
Stem quantity, spacing, and arrangement.
-
Leaf color, size, density, and foliage characteristics.
-
Root development and structure.
-
Seasonal growth stages and visual appearance.
Important Information About Starter Plants
If a product is identified as a starter plant, young plant, or seedling, the item supplied will be at an early stage of development rather than a mature specimen.
Images featuring established trees, colorful blooms, developed fruit, or full-sized plants are commonly provided to illustrate the species' mature characteristics.
Your delivered plant may be considerably smaller, younger, or visually different from the mature examples shown in photographs.
Before purchasing, please review the product title, description, listed dimensions, quantity, and shipping specifications.
Differences between a young plant and a mature reference image do not automatically constitute a defect or justify a refund.
4. Seasonal Plant Conditions & Appearance
Living plants may be shipped in varying natural growth conditions depending on species, season, weather patterns, and transportation requirements.
Depending on the product, your plant may arrive:
-
Fully or partially dormant.
-
Without leaves or with reduced foliage.
-
Recently trimmed or pruned.
-
Bare-root or containing a reduced amount of growing medium.
-
With fewer branches or leaves.
-
Showing minor cosmetic marks.
-
Displaying natural differences in stems, roots, and overall structure.
Certain plants require pruning, foliage reduction, or bare-root preparation to support safer packaging, minimize transportation stress, or comply with shipping requirements.
Dormant, pruned, leafless, or partially defoliated plants should not automatically be considered damaged, unhealthy, or dead.
Some varieties may take several weeks to display visible new growth following transportation or planting.
Recovery periods depend on the plant species, growing environment, and individual condition.
We cannot promise immediate leaf development, visible new growth, or recovery within a particular timeframe.
5. Normal Transportation Stress
Living plant materials can experience temporary physical or environmental stress during packaging, shipping, and adjustment to new surroundings.
Common signs of transportation-related stress include:
-
Yellowing foliage or occasional leaf shedding.
-
Temporary wilting or drooping.
-
Minor discoloration of leaves.
-
Small broken leaves or limited twig damage.
-
Reduced foliage density.
-
Slower initial growth after arrival.
-
Seasonal dormancy or transplant-related shock.
These conditions do not necessarily mean that a plant is unhealthy or no longer living.
Minor cosmetic changes and ordinary shipping stress do not automatically qualify an order for a refund or replacement.
We encourage customers to provide suitable after-delivery care, including gradual environmental adjustment, appropriate watering, proper drainage, and protection against extreme weather.
6. Weather Conditions & Growing Environment
Before purchasing live planting materials, customers should consider their regional climate, seasonal temperatures, and available growing conditions.
Plant health may be affected by environmental factors during shipping or after delivery, including:
-
Excessive summer temperatures.
-
Frost, freezing weather, or extremely low temperatures.
-
Severe storms and unexpected weather events.
-
Extended exposure to direct sunlight.
-
Packages remaining outdoors for prolonged periods.
-
Improper storage or delays in unpacking.
We strongly recommend checking shipment tracking regularly and making arrangements to receive live plants promptly.
Upon arrival, living plants should be unpacked and inspected as soon as reasonably practical.
Ever Thrive Garden cannot guarantee plant survival following exposure to extreme weather or unsuitable growing environments.
Nothing in this section removes remedies available under applicable consumer protection laws.
7. No Guarantee of Germination, Rooting, Growth, or Survival
Seeds, starter plants, cuttings, roots, and bulbs are biological materials whose growth and development depend on multiple environmental and care-related variables.
Successful germination, rooting, establishment, and continued plant development may be influenced by:
-
Regional climate and temperature conditions.
-
Soil composition, quality, and drainage.
-
Watering frequency and moisture management.
-
Sunlight exposure and humidity.
-
Planting depth and cultivation techniques.
-
Seasonal planting schedules.
-
Pest activity and plant diseases.
-
Individual gardening methods and experience.
We do not provide guarantees regarding germination percentages, rooting success, plant establishment, future growth, blooming, fruit production, or long-term survival.
Unless a product description specifically indicates otherwise, plant cuttings may be delivered without established roots.
Successful rooting or propagation is not guaranteed.
These growing-performance limitations do not exclude remedies for products that fail to meet applicable legal or contractual requirements.
8. Damaged Products, Dead-on-Arrival Plants & Incorrect Items
Although purchases are generally final, we recognize that occasional shipping damage, packing errors, or product discrepancies may arise.
If your order arrives with substantial damage, appears dead upon arrival, contains the wrong item, or differs materially from the specifications stated at purchase, please follow the 48-hour email reporting procedure described in Section 2.
Scratch Test Guidance
For appropriate woody plant varieties, a gentle scratch test on a small area of bark may help identify whether living tissue remains beneath the surface.
Green or moist tissue beneath the bark may indicate that a plant is still alive, even if foliage is absent.
However, scratch testing is not appropriate for every type of plant and should not be considered a universally conclusive test.
Plants experiencing dormancy, wilting, defoliation, or transportation stress are not automatically dead.
How Claims Are Evaluated
Submitting documentation does not automatically result in approval of a refund or replacement.
Our team reviews the available information, including:
-
The original product description and purchase specifications.
-
Photographic documentation provided by the customer.
-
Shipping circumstances and available tracking records.
-
The reported physical condition of the item.
-
Applicable consumer protection requirements.
When a claim is approved, the appropriate resolution may include:
-
Replacement of the affected product.
-
Partial reimbursement.
-
Full reimbursement.
-
Another suitable resolution based on the circumstances.
For goodwill requests outside mandatory legal remedies, Ever Thrive Garden determines the appropriate response individually, based on the available evidence and circumstances.
Returning live plants is generally unnecessary unless our customer support team specifically requests a return.
9. Delivery Delays, Missing Shipments & Carrier Concerns
After an order has been transferred to a shipping provider, transportation and delivery may be affected by events beyond our immediate control.
These may include:
-
Shipping carrier service interruptions.
-
Severe weather or natural disruptions.
-
Transportation delays.
-
Incorrect or delayed carrier tracking scans.
-
Theft following confirmed delivery.
-
Delivery problems caused by an incorrect address entered at checkout.
If your shipment is delayed, missing, damaged, or marked as delivered but cannot be found, please contact our customer service team and the shipping provider so the matter can be reviewed.
For our voluntary lost-package procedures, shipments marked as delivered by the carrier are generally treated as delivered, subject to any investigation and applicable legal requirements.
We cannot guarantee precise arrival dates or uninterrupted shipping services.
Any refund, replacement, or other remedy required under applicable law remains available regardless of carrier-related issues.
10. Incorrect or Missing Delivery Information
Customers are responsible for entering accurate and complete shipping details when placing an order.
Before submitting your purchase, please confirm the following information:
-
Recipient's full name.
-

If you notice an address mistake after placing an order, please contact us immediately.
We cannot guarantee address modifications once an order has entered preparation, fulfillment, or shipment.
11. Order Changes & Cancellation Requests
Orders may move into sourcing, packaging, or fulfillment shortly after checkout.
Customers wishing to modify or cancel a purchase should contact us as soon as possible.
Orders that have already shipped cannot be canceled.
Purchases that have entered product preparation, sourcing, or fulfillment may no longer qualify for voluntary cancellation.
Any cancellation or refund rights established by applicable law will continue to apply.

-
You have reviewed the product name, description, quantity, size, and relevant specifications.

Product photographs may illustrate mature plants or representative specimens instead of the exact item being shipped.

Starter plants and seedlings may differ substantially in appearance from fully grown examples.
